These terms and conditions ("Terms") set out the food hygiene and safety standards that partners of Swishr ("Swishr," "we," or "us") are required to adhere to in order to sell their products through the Swishr platform. By becoming a partner and selling your products through Swishr, you agree to comply with these Terms. Failure to comply may result in the suspension or termination of your access to our services.

  1. Purpose: We prioritise customer safety and believe that our partners share the same commitment. To ensure the safety of our customers and the quality of their food, strict food hygiene processes are essential. This policy outlines the food hygiene and safety standards that we expect our partners to meet.
  2. Partner Obligations: As a partner, you are responsible for ensuring that the products you sell are safe and compliant with all applicable laws and regulations. If you have any doubts about legal requirements, it is your responsibility to seek advice from an expert.
  3. Food Safety Procedures: We expect all partners to have food safety procedures in place that cover all aspects of food safety and hygiene for their business, in accordance with relevant food hygiene laws and regulations. These procedures should include, but are not limited to:
  • Hazard Analysis and Critical Control Point plans
  • Cross-contamination prevention
  • Allergen management
  • Cleaning and waste disposal protocols
  • Maintenance of equipment and facilities
  • Chilling, defrosting, freezing, cooking, reheating guidelines
  • Temperature control measures, particularly while awaiting collection by a rider
  • Personal hygiene and fitness-to-work policies for staff members
  • Pest control measures
  • Control of Hazardous Substances protocols
  • Takeaway packaging guidelines
  • Staff training programs on food safety practices
  • Supplier assurance procedures
  • Traceability systems for ingredients
  • Monitoring and auditing of food safety practices
  • Recall and withdrawal procedures
  1. Safe Packing of Food: Partners must use packaging that is robust and suitable for delivery purposes. All orders should be placed in sealed bags to minimize the risk of spillages and to maintain food at the correct temperature. Each bag must be clearly identified with a receipt and order number for easy identification by the rider. Additionally, partners should pack hot and cold items separately to ensure safe temperatures during transportation.
  2. Suspension or Termination: If we have reason to believe that a partner has breached these food hygiene and safety standards, we reserve the right to investigate the matter and take appropriate action, which may include suspending or terminating the provision of our services to the partner.
  3. Compliance with Laws: Partners must comply with all applicable laws and regulations relating to food hygiene and safety. Swishr reserves the right to request evidence of compliance at any time.
  4. Amendments: We reserve the right to amend these Terms at any time without prior notice. Partners will be notified of any changes, and it is their responsibility to review the updated Terms regularly.
  5. Governing Law: These Terms shall be governed by and construed in accordance with the laws of [jurisdiction]. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [jurisdiction].

By continuing to sell your products through Swishr, you acknowledge that you have read, understood, and agreed to comply with these food hygiene and safety standards as set out in these Terms.
